 CBP Refunds Not Offered During Government Shutdown

CBP confirmed on Oct. 6 that it cannot issue refunds or Treasury-related payments during the current government shutdown (“funding hiatus”). This includes drawback claims, approved protests, and post-summary corrections, due to funding restrictions.



Refunds were not issued last Tuesday and won’t be processed this week either, unless CBP receives updated instructions. This applies to all refund methods, including ACH and checks.

If a protest has already been approved, no further action is needed. Refunds are queued and will be processed once CBP is authorized to resume payments.

Interest will continue to accrue during the shutdown. If a refund is delayed beyond 30 days, interest will be owed to the importer under 19 U.S.C.1505, though this may be revisited if the shutdown is prolonged.

Most CBP staff remain on duty, but functions are limited to mission-critical activities. Cargo is still moving, but some processing delays may occur.

Importers with cargo under inspection holds should reach out to their broker to coordinate with ports, especially if another government agency is involved.
