Dear Customer,
U.S. Customs and Border Protection (CBP) has issued guidance implementing a temporary additional 10% import surcharge under Section 122 of the Trade Act of 1974, effective for qualifying goods entered on or after 12:01 a.m. EST on February 24, 2026.
What this means: Effective February 24, 2026:
- An additional 10% ad valorem duty applies to imported goods from all countries, unless specifically exempt
- This surcharge is currently scheduled to remain in effect through July 24, 2026
- The duty is applied under HTSUS heading 9903.03.01
- This surcharge applies in addition to any other applicable duties, including MFN, Section 301, Section 232, or other tariffs
Certain products and categories are exempt, including qualifying goods under USMCA, specific agricultural and industrial products, civil aircraft, informational materials, and other designated exemptions as defined by CBP.
Shipments previously eligible for de minimis treatment CBP has also confirmed that the suspension of duty-free de minimis treatment remains in effect.
As a result:
- Shipments previously eligible for duty-free entry under the de minimis threshold must continue to be formally entered
- Applicable duties, including the new Section 122 surcharge, may apply
- Existing entry and duty collection processes remain in place
Impact on supply chains
- Cargo continues to move normally through CBP entry processing
- Importers should expect updated duty calculations reflecting the additional surcharge where applicable
